This Privacy Policy describes the privacy practices of Akero Therapeutics, Inc. (“Akero,” “we,” “us,” or “our”) and how we handle personal information that we collect through our website and any other sites that link to this Privacy Policy (collectively, the “Site”).

Akero may provide additional or supplemental privacy notices to individuals for specific products or services that we offer at the time we collect the personal information, for example, in connection with our studies or clinical trials. These supplemental privacy policies govern how we may process your information in those contexts.

1. PERSONAL INFORMATION WE COLLECT

Personal Information You Provide: We may collect the following categories of personal information from you when you visit or otherwise interact with the Site.

Contact details, such as your first name, last name, phone number, and email address, when you request information, complete an online form, ask to download content, engage with our patient recruitment programs, or register for a webcast or other event.

Biographical and demographic information, some of which may be sensitive personal information, such as your date of birth, age, ethnicity, or gender, such as in connection with a patient recruitment program or other research.

Health and medical information, which may be sensitive personal information, such as information about your physical and mental health conditions, treatments, medications, or areas of interest in research, such as in connection with a patient recruitment program or other research.

Communications that we may collect communications that we exchange with you (such as the content of your message), including when you contact us with questions, feedback, or otherwise.

Marketing information, such as your preferences for receiving communications about our activities, events, studies, programs, and publications as well as details about how you engage with our communications.

Internet Activity Data: When you visit, use, and interact with the Site, we may receive certain information about your visit, use, or interactions. For example, we may analyze the number of people that visit the Site, peak hours of visits, which page(s) are visited, the domains our visitors come from (e.g., google.com, yahoo.com, etc.), and which browsers people use to access the Site, broad geographical information, and navigation pattern. In particular, the following information is created and automatically logged in our systems:

Log Data: Information that your browser automatically sends whenever you visit the Site, including your Internet Protocol address (so we understand which country you are connecting from when you visit the Site), browser type and settings, the date and time of your request, and how you interacted with the Site.

Device Data: Includes name of the device, operating system, and browser you are using. Information collected may depend on the type of device you use and its settings.

Cookies and Other Tracking Technologies: We use cookies and other tracking technologies to operate and administer our Site, gather usage data on our Site, and improve your experience on it. A “cookie” is a piece of information sent to your browser by a website you visit. Cookies can be stored on your computer for different periods of time. Some cookies expire after a certain amount of time, or upon logging out (session cookies), others survive after your browser is closed until a defined expiration date set in the cookie (as determined by the third party placing it), and help recognize your computer when you open your browser and browse the Internet again (persistent cookies).

Do Not Track Signals: The Site currently does not respond to “Do Not Track” (“DNT”) signals and operates as described in this Privacy Policy whether or not a DNT signal is received. If we do respond to DNT signals in the future, we will update this Privacy Policy to describe how we do so.

2. HOW WE USE PERSONAL INFORMATION

We may use personal information for the following purposes:

•To respond to your inquiries, comments, feedback, or questions;

•To send administrative information to you, for example, information regarding the Service and changes to our terms, conditions, and policies;

•To assess your eligibility for our research studies;

•To analyze the effectiveness of certain programs, such as patient recruitment programs to support our research activities;

•To comply with legal obligations and legal process and to protect our rights, privacy, safety, or property, and/or that of our affiliates, you, or other third parties.

Marketing. We may use your personal information to contact you to tell you information we believe may be of interest to you, such as upcoming events, announcements, information about products and services, surveys, newsletters. You may opt out of receiving emails as described in the “Opt out of marketing communications” section below. If you unsubscribe from our marketing lists, you will no longer receive marketing communications but we will continue to contact you regarding other administrative matters, and to respond to your requests.

3. SHARING AND DISCLOSURE OF PERSONAL INFORMATION

We may share your personal information with third parties in the ordinary course of business, as described below:

Service Providers: We may share personal information with providers of services on our behalf, including providers of research services, hosting services, cloud services, and other information technology services, email communication software, services, and analytics services.

Health Care Providers and Researchers: We may share personal information with health care providers and researchers in connection with certain programs, such as patient recruitment programs to support our research activities.

Professional Advisors: Professional advisors, such as lawyers, auditors, bankers, and insurers, where necessary in the course of the professional services that they render to us.

Business Transfers: If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of all or a portion of our assets, or transition of service to another provider (collectively a “Transaction”), your personal information and other information may be shared in the diligence process with counterparties and others assisting with the Transaction and transferred to a successor or affiliate as part of that Transaction along with other assets.

Legal Requirements: If required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, including to meet regulatory, national security or law enforcement requirements, (ii) protect and defend our rights or property, (iii) prevent fraud, (iv) act in urgent circumstances to protect the personal safety of users of the Site, or the public, or (v) protect against legal liability.

Google Analytics Opt Out: You can opt out of Google Analytics by downloading and installing a browser plugin available here.

Opt out of marketing communications. You may opt out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email, or by contacting us.

•In addition, depending on applicable law, you may have certain rights with respect your personal information. You can contact us to submit these requests unless otherwise specified below. These rights may include the following:

Update, access, correct, or delete. You may have the right to update, access, correct or delete your personal information. You may also have the right to request information about our collection and use of your personal information, such as the categories of personal information we collected about you and to whom we have disclosed that personal information.

Opt out of sale or sharing of personal information. You may have the right to opt out of any sale or sharing of your personal information for cross-context behavioral advertising.

Limit use and disclosure of sensitive personal information. You may have the right to request that we limit the use and disclosure of your sensitive personal information.

We will not discriminate against you for exercising any of the rights described above, although it may affect the way we are able to interact with you.

We may be required to authenticate your identity to assist you with your request, depending on the nature of your request. You may be entitled, in accordance with applicable law, to submit a request through an authorized agent or to appeal a refusal to take action on your request.

5. CHILDREN

The Site is not directed to children who are under the age of 18. We do not knowingly collect, sell, or share for cross-context behavioral advertising personal information from children under the age of 18. If you have reason to believe that a child under the age of 18 has provided personal information to us through the Site please contact us and we will endeavor to delete that information from our databases.

6. JOB APPLICANTS

When you visit the “Careers” portion of our Site, we collect the information that you provide to us in connection with your job application. This includes business and personal contact information, professional credentials and skills, educational and work history, and other information of the type that may be included in a resume. This may also include diversity information that you voluntarily provide. We use this information to facilitate our recruitment activities and process employment applications, such as by evaluating a job candidate for an employment activity, and monitoring recruitment statistics. We may also use this information to improve administration of the Site, and as otherwise necessary (a) to comply with relevant laws or to respond to subpoenas or warrants served on Akero; (b) to protect and defend the rights or property of Akero or others; (c) in connection with a legal investigation; and/or (d) to investigate or assist in preventing any violation or potential violation of the law, this Privacy Policy, or Akero’s Terms of Use.

7. LINKS TO OTHER WEBSITES

The Site may contain links to other websites not operated or controlled by Akero, including social media services (“Third-Party Sites”). The information that you share with Third-Party Sites will be governed by the specific privacy policies and terms of service of the Third-Party Sites and not by this Privacy Policy. By providing these links we do not imply that we endorse or have reviewed these sites. Please contact the Third-Party Sites directly for information on their privacy practices and policies.

8. SECURITY

You use the Site at your own risk. We have implemented commercially reasonable technical, administrative, and organizational measures designed to protect the confidentiality of personal information we process. However, no Internet or e-mail transmission is ever fully secure or error free. In particular, e-mail sent to or from us may not be secure. Therefore, you should take special care in deciding what information you send to us via the Site or e-mail. Please keep this in mind when disclosing personal information to Akero via the Internet. In addition, we are not responsible for circumvention of any privacy settings or security measures contained on the Site, or third party websites.

9. RETENTION OF PERSONAL INFORMATION

We will retain your information only for as long as necessary to fulfill the purpose(s) for which the information was collected, depending on the purpose(s) for which the information was collected, the nature of the information, any contractual relationship that may govern the retention of the data, and our legal or regulatory obligations.

10. INTERNATIONAL USERS

The Site is controlled and operated by Akero in the United States and is only intended for use by individuals accessing the Site from the United States. Unless another mechanism is required by applicable law, by using the Site, you understand and acknowledge that your personal information will be transferred from your location to the United States.

11. CHANGES TO THE PRIVACY POLICY

The Site and our business may change from time to time. As a result we may change this Privacy Policy at any time. When we do we will post an updated version on this page and revise the “last updated” date at the top of the Privacy Policy, unless another type of notice is required by the applicable law. By continuing to use the Site or providing us with personal information after we have posted an updated Privacy Policy, or notified you by other means if applicable, you consent to the revised Privacy Policy and practices described in it.
